Carpool.School provides the tools for families to find each other and coordinate; parents take on the responsibility when offering and participating in carpools. This fundamental structure separates the school from the onus of direct provision of transportation, placing the operational responsibility and associated risks squarely on the participating families.

2. Comprehensive and Binding User Agreements: A cornerstone of our liability mitigation is the requirement that all users of the Carpool.School Platform agree to our legal terms. This includes the End User License Agreement (EULA) for the Application and the Terms and Conditions of Use for the Website, which are legally binding contracts between the user and Carpool.School. The participating school also enters into a Terms of Service agreement with Carpool.School.

These agreements clearly articulate the roles and responsibilities of the users. By accepting these terms, users acknowledge and agree to key provisions that safeguard Carpool.School and the school facilitating access to the platform.

3. Clear Limitation of Liability and Warranty Disclaimers: Our legal documents contain explicit clauses limiting Carpool.School’s liability. For instance, our Terms of Service state that Carpool.School shall have no liability for consequential, exemplary, special, incidental, or punitive damages. Additionally, our total liability to the school is limited to the amount paid to Carpool.School by the school under the Terms. Users expressly acknowledge and accept these risks.

4. User Responsibility and Indemnification: Our terms clearly place responsibility for platform use on the end user. Users acknowledge and agree that they are responsible for all uses of the app and their actions within it. They also take full responsibility for ensuring their family’s personal safety when interacting with others met through the app. We provide suggested safety practices for users to consider. Importantly, our terms explicitly state that Carpool.School does not conduct criminal background screenings.

5. School’s Limited Role in Coordination: The Carpool.School platform is designed for family-to-family coordination. The school’s role is to enable the service for its community, and it is limited to this administration of the tool. Families sign up, indicate their interest, find potential carpool matches, and handle all communication and scheduling details themselves within the app. School staff are not involved in the operational aspects of matching families or organizing specific rides. This hands-off approach for school personnel further reduces potential liability tied to the day-to-day functioning of carpools.

8. Data Security and Privacy Considerations: We have implemented measures designed to secure personal information to the best of our abilities, as outlined in our Privacy Policy. This policy details what information we collect and how it may be used or disclosed, including to participating schools.
